Where you are using our services on behalf of a company, organisation, or rights holder, you confirm that you have the authority to act on behalf of that entity.
4. Use of Our Services
You agree to use our website and services only for lawful purposes.
You must not:
- Use our services for unlawful activities.
- Submit content that you do not have the authority to monitor or protect.
- Submit knowingly false or misleading information.
- Attempt to gain unauthorized access to our systems.

6. Content Monitoring
FairPlay Africa uses technology and other processes to identify potentially unauthorized distribution of monitored content.
Our monitoring may involve digital platforms, websites, social media platforms, messaging platforms, video-sharing platforms, and other online environments.
Although we use reasonable efforts to provide effective monitoring, we do not guarantee that every instance of unauthorized distribution will be identified.
7. Detection Results
A detection or monitoring result indicates that content or activity may require further review.
A detection does not automatically establish that a legal infringement has occurred.
Rights ownership, fair dealing, licensing, permissions, contractual rights, and other legal circumstances may affect whether particular use of content is lawful.
8. Takedown and Enforcement Assistance
Where requested and appropriate, FairPlay Africa may assist customers with reporting potentially unauthorized content to relevant platforms or service providers.
The final decision to remove, disable, restore, or retain content may be made by the relevant platform, service provider, rights holder, or competent authority.
FairPlay Africa does not guarantee that a third party will remove reported content.
9. Customer Content
Customers retain ownership of their content and intellectual property.
By submitting content or information to FairPlay Africa for the purpose of providing our services, you grant us the limited rights necessary to receive, process, analyze, monitor, store, and otherwise use that information for the agreed service.
We do not acquire ownership of customer intellectual property merely because it is submitted to us.
10. FairPlay Africa Intellectual Property
Unless otherwise stated, FairPlay Africa owns or has appropriate rights to its:
- Software.
- Platform.
- Technology.
- Website.
- Brand identity.
- Logos and trademarks.
- Content.
- Documentation.
- Systems.
- Methodologies.
- Designs.
- Databases.
- Proprietary processes.
Nothing in these Terms grants you ownership of FairPlay Africa's intellectual property.
11. Fees and Payment
Where a service is paid, the applicable pricing, service scope, payment schedule, subscription period, and other commercial terms will be communicated to the customer.

FairPlay Africa does not control those platforms and cannot guarantee their:

- Enforcement decisions.

- Technical performance.

However, we do not guarantee that the website or platform will always be available, uninterrupted, completely secure, or free from errors.

Our services do not constitute legal advice, legal representation, or a legal determination of copyright ownership or infringement.
Customers should seek independent legal advice where appropriate.
16. Disclaimer
To the maximum extent permitted by law, FairPlay Africa provides its services on the basis described in these Terms and applicable service agreements.
We do not guarantee that our services will:
- Detect every instance of unauthorized distribution.
- Prevent all forms of piracy.
- Result in the removal of reported content.
- Recover lost revenue.
- Guarantee a particular business or financial outcome.
17. Limitation of Liability
To the extent permitted by applicable law, FairPlay Africa will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from or relating to the use of our website or services.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.
