Our services are designed to help creators, filmmakers, media companies, and rights holders identify potentially unauthorized distribution of their content and take appropriate action.

You must have the legal capacity required to enter into an agreement with FairPlay Africa.

Where you are using our services on behalf of a company, organisation, or rights holder, you confirm that you have the authority to act on behalf of that entity.

You agree to use our website and services only for lawful purposes.

You must not:

• Use our services for unlawful activities.
• Submit content that you do not have the authority to monitor or protect.
• Submit knowingly false or misleading information.
• Attempt to gain unauthorized access to our systems.
• Interfere with or disrupt our technology or infrastructure.
• Circumvent security or access controls.
• Abuse, harass, impersonate, or unlawfully target another person or organisation.
• Use our services to infringe the rights of others.
• Attempt to reverse engineer, copy, modify, or exploit our proprietary technology except where permitted by law or expressly agreed in writing.

Customers are responsible for ensuring that they have all necessary rights, permissions, licences, and authority required to submit content for monitoring or protection.

You are also responsible for ensuring that information provided to FairPlay Africa is accurate and up to date.

FairPlay Africa uses technology and other processes to identify potentially unauthorized distribution of monitored content.

Our monitoring may involve digital platforms, websites, social media platforms, messaging platforms, video-sharing platforms, and other online environments.

Although we use reasonable efforts to provide effective monitoring, we do not guarantee that every instance of unauthorized distribution will be identified.

A detection or monitoring result indicates that content or activity may require further review.

A detection does not automatically establish that a legal infringement has occurred.

Rights ownership, fair dealing, licensing, permissions, contractual rights, and other legal circumstances may affect whether particular use of content is lawful.

Where requested and appropriate, FairPlay Africa may assist customers with reporting potentially unauthorized content to relevant platforms or service providers.

The final decision to remove, disable, restore, or retain content may be made by the relevant platform, service provider, rights holder, or competent authority.

FairPlay Africa does not guarantee that a third party will remove reported content.

Customers retain ownership of their content and intellectual property.

By submitting content or information to FairPlay Africa for the purpose of providing our services, you grant us the limited rights necessary to receive, process, analyze, monitor, store, and otherwise use that information for the agreed service.

We do not acquire ownership of customer intellectual property merely because it is submitted to us.

Unless otherwise stated, FairPlay Africa owns or has appropriate rights to its:

• Software.
• Platform.
• Technology.
• Website.
• Brand identity.
• Logos and trademarks.
• Content.
• Documentation.
• Systems.
• Methodologies.
• Designs.
• Databases.
• Proprietary processes.

Nothing in these Terms grants you ownership of FairPlay Africa's intellectual property.

Where a service is paid, the applicable pricing, service scope, payment schedule, subscription period, and other commercial terms will be communicated to the customer.

Certain customers may enter into separate contracts, service agreements, order forms, or subscription agreements.

Those agreements may contain additional terms that apply to the relevant service.

Refunds and cancellations are subject to our Refund & Cancellation Policy and any specific contractual arrangement between FairPlay Africa and the customer.

Our services may involve monitoring or interacting with third-party platforms.

FairPlay Africa does not control those platforms and cannot guarantee their:

• Availability.
• Policies.
• Algorithms.
• Enforcement decisions.
• Response times.
• Content moderation processes.
• Technical performance.

We aim to maintain reliable and secure services.

However, we do not guarantee that the website or platform will always be available, uninterrupted, completely secure, or free from errors.

Services may be affected by maintenance, technical failures, third-party infrastructure, cybersecurity incidents, internet disruptions, or circumstances beyond our reasonable control.

FairPlay Africa is a technology and content protection company.

Our services do not constitute legal advice, legal representation, or a legal determination of copyright ownership or infringement.

Customers should seek independent legal advice where appropriate.

To the maximum extent permitted by law, FairPlay Africa provides its services on the basis described in these Terms and applicable service agreements.

We do not guarantee that our services will:

• Detect every instance of unauthorized distribution.
• Prevent all forms of piracy.
• Result in the removal of reported content.
• Recover lost revenue.
• Guarantee a particular business or financial outcome.

To the extent permitted by applicable law, FairPlay Africa will not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from or relating to the use of our website or services.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to indemnify and hold FairPlay Africa harmless from claims, losses, liabilities, damages, or expenses arising from:

• Your unlawful use of our services.
• Your breach of these Terms.
• Your submission of content without the necessary rights or authority.
• Your violation of the rights of another person or organisation.
