How copyright-related reports are submitted, reviewed, and handled through FairPlay Africa's content protection services.
1. Purpose
FairPlay Africa is committed to supporting creators, filmmakers, production companies, media organisations, publishers, and other rights holders in identifying and responding to potentially unauthorized distribution of their digital content.
This Copyright & Takedown Policy explains how copyright-related reports may be submitted and how FairPlay Africa may assist rights holders with monitoring and reporting.
2. Who Can Submit a Copyright Report?
A copyright report should be submitted by:
- The copyright owner; or
- An authorized representative of the copyright owner.
If you are submitting a report on behalf of another person or organisation, you may be required to provide evidence that you have authority to act on their behalf.
3. Types of Content That May Be Reported
Reports may relate to potentially unauthorized distribution of audiovisual and digital content, including where applicable:
- Films.
- Movies.
- Television content.
- Web series.
- Short films.
- Documentaries.
- Trailers and promotional materials.
- Original digital productions.
- Other protected audiovisual works.
4. Information Required for a Report
To help us assess a report, we may require:
- The name of the copyright owner.
- Identification of the copyrighted work.
- Evidence of ownership or authorization.
- A description of the allegedly unauthorized use.
- The URL or location of the content.
- Relevant account, channel, page, or profile information.
- Contact details of the reporting party.
- Any other information reasonably necessary to investigate the report.
5. Monitoring and Detection
FairPlay Africa may use technology, automated systems, digital identifiers, content fingerprints, search systems, monitoring tools, and human review to identify potentially unauthorized distribution.
Our systems are designed to identify content that may require further review or action.
A detection does not automatically establish that infringement has legally occurred.
6. Verification
Where appropriate, FairPlay Africa may review detected content and available information before assisting with a report.
The circumstances surrounding a particular use may affect whether it constitutes infringement.
Where necessary, customers may be asked to provide additional evidence of ownership or authorization.
7. Takedown Assistance
Where a customer has the necessary rights and requests assistance, FairPlay Africa may assist with preparing, organizing, or submitting copyright reports to relevant platforms or service providers.
The relevant platform, service provider, rights holder, or competent authority may make the final decision regarding whether content should be removed, disabled, restored, or retained.
FairPlay Africa cannot guarantee that a reported item will be removed.
8. False or Misleading Reports
All copyright reports must be made honestly and in good faith.
You must not knowingly submit:
- False ownership claims.
- Misleading information.
- Fraudulent evidence.
- Reports against content you do not have authority to challenge.
Abuse of the reporting process may result in suspension or termination of services and may have legal consequences.
9. Counter-Notices and Disputes
Where a third-party platform provides a counter-notice, appeal, dispute, or restoration process, the relevant parties may use that process in accordance with the platform's procedures and applicable law.
FairPlay Africa does not act as a court and does not make final determinations regarding disputed ownership.
10. Customer Responsibility
Customers remain responsible for ensuring that they have the legal authority to request monitoring or enforcement assistance concerning the content they submit.
FairPlay Africa may request evidence of ownership or authorization before processing a request.
11. Legal Advice
FairPlay Africa provides technology-enabled monitoring and content protection services.
Nothing in this Policy constitutes legal advice or legal representation.
Where a matter involves complex copyright ownership, litigation, licensing disputes, or other legal questions, customers should seek advice from a qualified legal professional.
12. Third-Party Platforms
FairPlay Africa may interact with or submit reports to third-party platforms.
Each platform may have its own copyright policies, procedures, requirements, response times, and enforcement standards.
FairPlay Africa does not control these third-party decisions.
13. Policy Changes
We may update this Policy from time to time.
The "Last Updated" date will be changed when material changes are made.
